{"id":1133,"date":"2012-06-25T16:57:59","date_gmt":"2012-06-25T20:57:59","guid":{"rendered":"http:\/\/monachuslex.com\/?p=1133"},"modified":"2012-06-25T16:57:59","modified_gmt":"2012-06-25T20:57:59","slug":"new-virginia-gun-laws-taking-effect-july-1st-2012","status":"publish","type":"post","link":"https:\/\/monachuslex.com\/?p=1133","title":{"rendered":"New Virginia Gun Laws Taking Effect July 1st, 2012"},"content":{"rendered":"<p><a href=\"https:\/\/monachuslex.org\/wp-content\/uploads\/2012\/06\/Seal_Virginia.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-1134\" title=\"Seal_Virginia\" src=\"https:\/\/monachuslex.org\/wp-content\/uploads\/2012\/06\/Seal_Virginia.png\" alt=\"\" width=\"220\" height=\"220\" \/><\/a>Once again, the <a href=\"http:\/\/www.vcdl.org\" target=\"_blank\">Virginia Citizens Defense League<\/a> has delivered for Virginia gun owners. \u00a0Thanks to the tireless efforts of VCDL activists, the\u00a02012 Legislative Session was even more of a rousing success than the <a href=\"https:\/\/monachuslex.com\/?p=65\" target=\"_blank\">2011 Session<\/a>. \u00a0Not only was every single anti-gun bill opposed by VCDL defeated but the session ended with almost a dozen VCDL supported bills passed by the Legislature and signed by Governor McDonnell.<\/p>\n<p>These important changes will take effect on July 1st &#8230;<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Better Protection For Gun Owners During Declared Emergencies<\/strong><\/span><\/p>\n<p>I have <a href=\"https:\/\/monachuslex.com\/?p=235\" target=\"_blank\">written before<\/a> about the dangers of emergency declarations stripping citizens of their right to keep and bear arms. \u00a0Virginia <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+44-146.15\" target=\"_blank\">code\u00a0\u00a7 44-146.15<\/a> governs the constitutional limitations placed upon such declarations in Virginia and <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+HB20\" target=\"_blank\">HB 20<\/a>, sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+H231\" target=\"_blank\">Delegate Wilt<\/a>, improved this code section to provide that:<\/p>\n<blockquote><p>Nothing in this chapter is to be construed to:<br \/>\n&#8230;<br \/>\n(3) Empower the Governor, any political subdivision, or any other governmental authority to in any way limit or prohibit the rights of the people to keep and bear arms as guaranteed by Article I, Section 13 of the Constitution of Virginia or the Second Amendment of the Constitution of the United States, including the otherwise lawful possession, carrying, transportation, sale, or transfer of firearms except to the extent necessary to ensure public safety in any place or facility designated or used by the Governor, any political subdivision of the Commonwealth, or any other governmental entity as an emergency shelter or for the purpose of sheltering persons;<\/p><\/blockquote>\n<p>The senate version of this bill, sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+S68\" target=\"_blank\">Senator Obenshain<\/a>, was <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+SB245\" target=\"_blank\">SB 245<\/a>.<\/p>\n<p>Note that this change still allows gun owners to be disarmed in emergency shelters. \u00a0That will need to be addressed in future legislative sessions.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>We Don&#8217;t Need No Stinking Gun Buybacks<\/strong><\/span><\/p>\n<p><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+HB22\" target=\"_blank\">HB 22<\/a>, sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+H142\" target=\"_blank\">Delegate Cole<\/a>, prevents localities from participating in so-called &#8220;gun buybacks&#8221; unless they have first passed an express ordinance authorizing the participation. \u00a0And in the event that they do hold such an event, the firearms thus collected must be offered for sale to the public or a licensed dealer.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Forgot Your Permit Today? \u00a0No Problem<\/strong><\/span><\/p>\n<p><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+HB26\" target=\"_blank\">HB 26<\/a>,\u00a0sponsored by\u00a0<a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+H142\" target=\"_blank\">Delegate Cole<\/a>, provides that failure to have your permit and a photo-id on your person while exercising the privilege of carrying a concealed firearm only results in a $25 civil penalty and the fact that you had a concealed handgun permit at the time of an infraction but simply forgot to have it with you is an affirmative defense to a charge of carrying a concealed handgun.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Localities Can&#8217;t Control Guns in Employee&#8217;s Automobiles<\/strong><\/span><\/p>\n<p><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+HB375\" target=\"_blank\">HB 375<\/a>, sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+H203\" target=\"_blank\">Delegate Pogge<\/a>, provides that localities may not adopt or enforce any workplace rules that abrogates the employee&#8217;s right to have a lawfully-possessed firearm in a locked personal vehicle.<\/p>\n<p>Note that this bill specifically exempts state agencies. \u00a0One of the most important issues we need to address in future sessions is extending complete preemption to state agencies.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>No More Fingerprinting<\/strong><\/span><\/p>\n<p>Although most jurisdictions have long since eliminated fingerprinting for concealed handgun permit applicants, state law still allowed jurisdictions the option when issuing first-time permits. \u00a0<a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+HB754\" target=\"_blank\">HB 754<\/a>, sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+H161\" target=\"_blank\">Delegate Cline<\/a>, removes this option.<\/p>\n<p>The Senate version of this bill is <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+SB67\" target=\"_blank\">SB 67<\/a> which was sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+S82\" target=\"_blank\">Senator Stanley<\/a>.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Some Much-Needed Housekeeping<\/strong><\/span><\/p>\n<p><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+SB563\" target=\"_blank\">SB 563<\/a>, sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+S59\" target=\"_blank\">Senator Ruff<\/a>, makes some much-needed clarifications to the application process. \u00a0Many jurisdictions had added extra-legal requirements and were requesting information beyond that which is requested on the application form developed by the VA State Police. \u00a0Senator Ruff&#8217;s bill makes it clear that &#8230;<\/p>\n<blockquote><p>No information or documentation other than that which is allowed on the application in accordance with this subsection may be requested or required by the clerk or the court.<\/p><\/blockquote>\n<p>The bill also made it clear that, once approved, the permit could be issued via postal mail as opposed to requiring the applicant to appear and pick it up in person. \u00a0This too had become an issue in several jurisdictions.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Oh &#8230; You Want ID to Vote?<\/strong><\/span><\/p>\n<p><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+SB663\" target=\"_blank\">SB 663<\/a>, sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+S77\" target=\"_blank\">Senator Smith<\/a>, makes it clear that a concealed handgun permit is a valid form of ID when voting.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Say Goodbye And Good Riddance to &#8220;One-Gun-a-Month&#8221;<\/strong><\/span><\/p>\n<p>I saved the best for last. \u00a0The most publicized victory of the year was, without a doubt, the elimination of Virginia&#8217;s &#8220;One-Gun-a-Month&#8221; law. \u00a0Passed under Governor Wilder,\u00a0&#8220;One-Gun-a-Month&#8221; was heralded by anti-gunners as a model piece of gun-control legislation. \u00a0It has long been an\u00a0embarrassment\u00a0to Virginia gun rights advocates that one of the most pro-gun states in the union had such a disastrous piece of legislation.<\/p>\n<p>VCDL has been working for years to eliminate\u00a0&#8220;One-Gun-a-Month&#8221; and has been successful in adding exceptions for permit holders and trade-ins in previous sessions. \u00a0But these exceptions are no longer needed after July 1 thanks to House bill <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+HB940\" target=\"_blank\">HB \u00a0940<\/a>\u00a0sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+H148\" target=\"_blank\">Delegate Lingamfelter<\/a>\u00a0and Senate bill <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+sum+SB323\" target=\"_blank\">SB 323<\/a>\u00a0sponsored by <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?121+mbr+S84\" target=\"_blank\">Senator Carico<\/a>.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>What&#8217;s Next?<\/strong><\/span><\/p>\n<p>Now we begin looking to the 2013 Legislative Session. \u00a0How can you get involved?<\/p>\n<p>1) \u00a0<a href=\"http:\/\/www.vcdl.org\/static\/join.html\" target=\"_blank\">Join VCDL<\/a>.<\/p>\n<p>2) Send a &#8220;Thank You!&#8221;
