{"id":1383,"date":"2012-07-26T16:08:10","date_gmt":"2012-07-26T20:08:10","guid":{"rendered":"http:\/\/monachuslex.com\/?p=1383"},"modified":"2012-07-26T16:08:10","modified_gmt":"2012-07-26T20:08:10","slug":"why-gun-owners-should-fear-a-second-term-for-president-obama","status":"publish","type":"post","link":"https:\/\/monachuslex.com\/?p=1383","title":{"rendered":"Why gun owners should fear a second term for President Obama"},"content":{"rendered":"<p><em><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-1384\" title=\"\" src=\"https:\/\/monachuslex.org\/wp-content\/uploads\/2012\/07\/Stern_Obama-300x294.jpeg\" alt=\"\" width=\"300\" height=\"294\" \/>\u201cAs those of you who are familiar with my record know, I have consistently made gun control one of my top priorities.\u201d<\/em><\/p>\n<p style=\"text-align: right;\">&#8211; <a href=\"http:\/\/ddd-hph.dlconsulting.com\/cgi-bin\/newshph?a=d&amp;d=HPH20000112.1.4&amp;e=00-00-0000-99-99-9999--20--1----obama+guns-all\" target=\"_blank\">President Obama<\/a><\/p>\n<p><strong>This is the first of a two-part article on the failings of both presidential candidates where individual rights are concerned.<\/strong><\/p>\n<p>Let me start this topic by saying that I try very hard to not address politics as an ideologue.\u00a0 It is important to address facts if one wishes to retain credibility, so I want to explain why I believe that a second Obama presidency would be dangerous for gun rights.<\/p>\n<p>First, I should concede that <a href=\"https:\/\/monachuslex.com\/?p=229\" target=\"_blank\">President Obama has very wisely avoided directly attacking gun rights during his first term<\/a>.\u00a0 He even signed legislation allowing open and concealed carry in National Parks and Wildlife Refuges as well as allowing firearms on Amtrak trains.<\/p>\n<p>But I do not for a minute believe that the president is a supporter of gun rights and his comments following the Aurora, Colorado tragedy support this position. \u00a0Under intense pressure from anti-gun supporters, President Obama appears ready to return to his Illinois roots where gun control is concerned.<\/p>\n<p><a href=\"http:\/\/www.washingtontimes.com\/news\/2012\/jul\/25\/obama-calls-measures-against-gun-violence\/\" target=\"_blank\">Speaking yesterday to the National Urban League<\/a>, President Obama made several comments that should deeply concern gun owners. \u00a0He began by using classic divide-and-conquer techniques with co-called &#8220;assault weapons&#8221; as the wedge issue. \u00a0He stated that \u201c<em>A lot of gun owners would agree that AK-47s belong in the hands of soldiers, not in the hands of criminals.<\/em>\u201d<\/p>\n<p>The problem? \u00a0There is a third choice Mr. President and that is for these sporting rifles to be in the hands of law-abiding citizens. \u00a0I guess in his mind, we are already in the category of &#8216;criminals&#8217;.<\/p>\n<p>He went on to complain bitterly that\u00a0\u201copposition in Congress\u201d had prevented the passage of more restrictive gun laws. \u00a0Clearly his first-term avoidance of the issue has been based on the realities of re-election and not on his claimed move to the center. \u00a0He seems to be more than willing to make his second term be true to his early years.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>The Early Years<\/strong><\/span><br \/>\nOn that note, let\u2019s look at those early years and what he had to say about citizens rights to keep and bear arms and defend their homes and families &#8230;<\/p>\n<ul>\n<li>On December 13, 1999, while just starting his primary campaign against Bobby Rush, Obama spoke at a church in chicago where he laid out <a href=\"http:\/\/www.huffingtonpost.com\/2012\/07\/23\/barack-obama-guns_n_1696708.html?1343089077\" target=\"_blank\">an agressive agenda<\/a>\u00a0against gun ownership including:\n<ul>\n<ul>\n<li>Increasing federal taxes on the sale of firearms and ammunition by 500%<\/li>\n<li>Banning all gun stores within 5 miles of a school or a park (effectively banning them nationwide)<\/li>\n<\/ul>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>In February of 2001, he told the Chicago Defender that he supports a complete ban on so-called \u201cassault weapons\u201d, handgun registration and rationing of handgun purchases.<\/li>\n<\/ul>\n<ul>\n<li>In December of 2003, while running for the US Senate, he answered a\u00a0questionnaire from the\u00a0Independent Voters of Illinois. \u00a0In <a href=\"http:\/\/blogs.suntimes.com\/sweet\/2007\/12\/sweet_column_obamas_2003_iviip.html\" target=\"_blank\">his response to that questionnaire<\/a>, he stated that &#8220;<em>I would support banning the sale of ammunition for assault weapons and limiting the sale of ammunition for handguns.<\/em>&#8221; \u00a0In the same questionnaire, he states his support for a complete ban on &#8220;assault weapons&#8221; and bemoans the fact that a complete ban on handguns is &#8220;not politically practicable.&#8221;<\/li>\n<\/ul>\n<ul>\n<li>In 2003, a 52-year-old Wilmette Illinois resident, was arrested and charged with a misdemeanor violation of the local handgun ban after shooting a home invader. In March 2004, the Illinois Senate passed a bill in response to this case providing that self-defense requirements would be viewed to take precedence over local ordinances against handgun possession. <a href=\"http:\/\/www.ilga.gov\/legislation\/votehistory\/93\/senate\/09300SB2165_03252004_020000T.pdf\" target=\"_blank\">Barack Obama was one of the 20 state senators voting against the measure<\/a>.<\/li>\n<\/ul>\n<ul>\n<li>On February 20, 2004, he told the Chicago Tribune that he supported federal legislation to overturn state concealed carry laws.<\/li>\n<\/ul>\n<ul>\n<li>On July 29, 2005, while a Senator, he voted for a Kennedy sponsored amendment that would have banned all full metal jacket surplus ammo in 223 Remington, 308 Winchester, and 7.62&#215;39.<\/li>\n<\/ul>\n<ul>\n<li>In July 2007 at a campaign event in Chicago, candidate Obama promised a permanent reinstatement of the so-called \u201cAssault Weapons Ban.\u201d<\/li>\n<\/ul>\n<ul>\n<li>On November 20, 2007, he told the Chicago Tribune that he believed the absolute ban on handguns in DC was constitutional.<\/li>\n<\/ul>\n<ul>\n<li>On April 7, 2008, <a href=\"http:\/\/triblive.com\/x\/pittsburghtrib\/news\/s_560181.html\" target=\"_blank\">he told the Pittsburgh Tribune-Review<\/a> that he continues to oppose concealed carry laws.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\"><strong>Members of the Administration<\/strong><\/span><br \/>\nAnd that\u2019s not all.\u00a0 The real issue with a sitting president is those he appoints to positions of power in his administration.<\/p>\n<ul>\n<li>On January 19, 2009 Attorney General Nominee Eric Holder spoke at his confirmation hearing about gun controls he felt would be acceptable in a post-Heller America and mentioned the so-called \u201cAssault Weapons Ban\u201d as one such control.<\/li>\n<\/ul>\n<ul>\n<li>On February 25, 2009, then-seated Attorney General Holder stated that the Obama Administration would seek to reinstate the so-called \u201cAssault Weapons Ban.\u201d<\/li>\n<\/ul>\n<ul>\n<li>On March 25, 2009, Secretary of State Hillary Clinton spoke out in support of a renewal of the so-called \u201cAssault Weapons Ban\u201d.<\/li>\n<\/ul>\n<ul>\n<li>And most recently, the investigation continues into the ATF\u2019s Fast &amp; Furious scandal with Attorney General Holder looking more and more culpable in a scheme which may have been aimed at providing support for gun control efforts rather than actually interdicting illegal purchases.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\"><strong>Appointment of Judges<\/strong><\/span><br \/>\nBut the real crux of my argument involves the ability to appoint judges.\u00a0 This is a numbers game and the numbers are truly frightening.\u00a0 During his first term alone President Obama has appointed two Supreme Court justices, 35 Court of Appeals judges, and 139 district court judges.<\/p>\n<p>How does this affect gun rights?<\/p>\n<p>DC v. Heller was only decided by a 5-4 majority.\u00a0 Roberts, Scalia, Kennedy, Thomas, and Alito were the majority.<\/p>\n<p>McDonald v. Chicago was only decided by a 5-4 majority.\u00a0 The same 5 conservative justices were the majority.\u00a0 Revealingly, President Obama\u2019s first nominee to the Supreme Court, <a href=\"https:\/\/monachuslex.com\/?p=218\" target=\"_blank\">Justice Sotomayor<\/a> joined the dissent characterizing the right to keep and bear arms for self-defense as \u201cnot fundamental\u201d.<\/p>\n<p>And here are some more numbers that should worry gun owners:\u00a0 Justice Scalia is 76 this year.\u00a0 Justice Kennedy is 75.\u00a0 If either of those justices decides to step down or suffers a health problem during the next four years then you can rest assured that any nominee President Obama puts forward will not vote the right way on the next gun rights case, many of which are already working their way up through the courts of appeal.<\/p>\n<p>On the other side of the coin, Justice Ginsburg is 79 this year and Justice Breyer is 73.\u00a0 If either of these justices were to retire from the court, there would be an opportunity to shore up the slim majority that we currently hold in the Supreme Court.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Executive Orders &amp; Administrative Rulemaking<\/strong><\/span><br \/>\nI could go on and speak about the ability of the President to use executive orders and administrative rulemaking, powers that he has been more than willing to use during his first term.\u00a0 On October 24, 2011, he was addressing a Nevada crowd about Congress\u2019 unwillingness to go along with certain of his proposals.\u00a0 He said \u201c<em>We can\u2019t wait for an increasingly dysfunctional Congress to do its job. Where they won\u2019t act, I will \u2026 I\u2019ve told my administration to keep looking every single day for actions we can take without Congress \u2026 and we\u2019re going to be announcing these executive actions on a regular basis.<\/em>\u201d<\/p>\n<p>A good example of how this might play out in the gun rights arena can already be seen in the efforts of the BATFE to ban importation of certain firearms during his first term.<\/p>\n<p>In March of 2010, the BATFE banned the re-importation of American-made M1 Garands and M1 Carbines which the South Korean government wished to sell back into the U.S. market.\u00a0 In justifying the ban, the Obama Administration stated that they \u201cfeared the guns could fall into the wrong hands.\u201d<\/p>\n<p>In the Fall of 2011, the BATFE tried to ban the importation of Russian made Saiga shotguns, claiming that they did not have a \u201csporting purpose\u201d but was thwarted when Congress added an amendment to one of the 2012 transportation appropriations bills preventing them from going forward with the ban.<\/p>\n<p>Remember \u2026 When President Obama\u2019s campaign says that he does not want to ban guns, these examples say otherwise.\u00a0 And I suspect that they are minor compared to what we would see during a second term when there is no re-election pressure.<\/p>\n<p>I will leave you with the words that President Obama spoke to Russian President Dmitry Medvedev in March of this year when he thought his mike was turned off, &#8220;<em>This is my last election and after my last election I have more flexibility.<\/em>&#8221;<\/p>\n<p>He was speaking about missile defense but make no mistake about it, that flexibility extends to all elements of his agenda.\u00a0 Gun owners should be very concerned that they will be in the crosshairs in a second Obama administration.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u201cAs those of you who are familiar with my record know, I have consistently made gun control one of my top priorities.\u201d &#8211; President Obama This is the first of a two-part article on the failings of both presidential candidates &hellip; <a href=\"https:\/\/monachuslex.com\/?p=1383\">Continue reading <span class=\"meta-nav\">&rarr;<\/span><\/a><\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3,36,63,79,80],"tags":[],"class_list":["post-1383","post","type-post","status-publish","format-standard","hentry","category-assault-weapons","category-gun-control","category-national-politics","category-president-obama","category-presidential-politics"],"_links":{"self":[{"href":"https:\/\/monachuslex.com\/index.php?rest_route=\/wp\/v2\/posts\/1383","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/monachuslex.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/monachuslex.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/monachuslex.com\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/monachuslex.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=1383"}],"version-history":[{"count":0,"href":"https:\/\/monachuslex.com\/index.php?rest_route=\/wp\/v2\/posts\/1383\/revisions"}],"wp:attachment":[{"href":"https:\/\/monachuslex.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=1383"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/monachuslex.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=1383"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/monachuslex.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=1383"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
