{"id":20,"date":"2011-06-15T14:49:01","date_gmt":"2011-06-15T14:49:01","guid":{"rendered":"http:\/\/monachuslex.com\/?p=20"},"modified":"2011-06-15T14:49:01","modified_gmt":"2011-06-15T14:49:01","slug":"wisconsin-senate-passes-carry-bill","status":"publish","type":"post","link":"https:\/\/monachuslex.com\/?p=20","title":{"rendered":"Wisconsin Senate Passes Carry Bill"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-21\" title=\"Wisconsin Capitol\" src=\"https:\/\/monachuslex.org\/wp-content\/uploads\/2011\/06\/wisconsin-capitol.jpg\" alt=\"Wisconsin Capitol\" width=\"300\" height=\"210\" \/>The Wisconsin Senate has passed Senator Pam Galloway&#8217;s (R &#8211; Wausau)\u00a0Carry Bill <a href=\"https:\/\/docs.legis.wisconsin.gov\/2011\/proposals\/sb93\" target=\"_blank\">SB93<\/a> despite a flurry of last minute amendments offered by Senate Democrats. \u00a0Among other things, the amendments would have significantly weakened the resulting bill by greatly increasing the number of locations off-limits to those with a carry permit.<\/p>\n<p>But perhaps most egregious from my perspective, Senators Erpenbach (D &#8211; Middleton)\u00a0and Risser (D &#8211; Madison)\u00a0offered an amendment to bring open carry, long-held to be a right under the Wisconsin state constitution, under the auspices of the new law such that unlicensed open carry would no longer be legal.<\/p>\n<p>It was also Senators Erpenbach \u00a0and Risser who introduced the amendment that would have created a minefield of off-limits places for permit-holders while an amendment by Senator Carpenter (D &#8211;\u00a0Milwaukee) would have then transformed a violation of the carry statute from a Class A Misdemeanor to a Class H Felony with a mandatory 3 year sentence.<\/p>\n<p>Under Senators Erpenbach and Risser&#8217;s amendment, the places you would not have been able to carry would have included:<\/p>\n<div>\n<ul>\n<li>The state capitol building<\/li>\n<li>The state capitol park.<\/li>\n<li>Any building or portion of a building that is owned, occupied, or controlled\u00a0by the state or any political subdivision of the state (localities, agencies, bureaus, etc).<\/li>\n<li>A clinic or office that is used by a licensed physician.<\/li>\n<li>A building or portion of a building used by a health care facility.<\/li>\n<li>Any church, synagogue, mosque, or other building, structure, or place\u00a0primarily used for religious worship or another religious purpose.<\/li>\n<li>A building or any portion of a building that is used for a domestic violence\u00a0victim services program or by an organization that provides a safe haven for victims\u00a0of domestic violence.<\/li>\n<li>A place that is on the grounds of a University of Wisconsin institution or\u00a0extension.<\/li>\n<li>A private college or university.<\/li>\n<li>A technical college district.<\/li>\n<li>Any premises for which a Class &#8220;B&#8221; (alcohol sales) license or permit has been\u00a0issued.<\/li>\n<li>Any building or part of a building that is used to provide child care services,\u00a0except that, if the building is a residence and the owner is a licensee, any weapon that\u00a0is unloaded and securely locked or encased during the hours in which children are\u00a0present for the child care services.<\/li>\n<li>Any building or part of a building that is used by a county department of\u00a0human services.<\/li>\n<li>Any building or part of a building that is used as a nonprofit organization.<\/li>\n<li>Any venue, or stadium at which public sporting events or public concerts\u00a0are held.<\/li>\n<li>Any amusement park, except that if an event related to firearms is taking\u00a0place and the weapon is being used at the event.<\/li>\n<li>Any building or part of a building where a bingo, raffle, lottery or race is\u00a0conducted.<\/li>\n<li>Any place that is within 1,000 feet of a polling place on an election day.<\/li>\n<li>On any vehicle used for public transportation purposes.<\/li>\n<li>Any public library.<\/li>\n<li>Any common area in a building that is a residence that is not a\u00a0single-family residence if the actor does not own the residence or does not occupy any\u00a0part of the residence.<\/li>\n<\/ul>\n<\/div>\n<p>In the final vote, the bill easily passed 25 &#8211; 8 with six Democrats bravely crossing the aisle to vote for the civil rights of all Wisconsin citizens. \u00a0Wisconsin voters will do well to remember the vote breakdown below when it comes time to contribute time and money in the next election cycle.<\/p>\n<div><span style=\"font-size: small;\"><span style=\"line-height: 24px;\"><a href=\"http:\/\/legis.wisconsin.gov\/2011\/data\/votes\/sv0220.pdf\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-22\" title=\"Senate Vote on SB93\" src=\"https:\/\/monachuslex.org\/wp-content\/uploads\/2011\/06\/Screen-shot-2011-06-15-at-9.56.13-AM.png\" alt=\"\" width=\"576\" height=\"379\" \/><\/a><\/span><\/span><\/div>\n<p>The bill now moves on the the Assembly where it will be first heard in the <a href=\"http:\/\/legis.wisconsin.gov\/w3asp\/commpages\/IndividualCommittee.aspx?commid=526\" target=\"_blank\">Rules Committee<\/a> as early as later this week.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Wisconsin Senate has passed Senator Pam Galloway&#8217;s (R &#8211;
